FMLA – Family and Medical Leave Act

There are times in life when we need to care for a family member or for ourselves due to a medical reason. To allow for these absences due to a medical reason (absence is defined as any time away from work lasting longer than 3 consecutive days), we provide up to 12 weeks per rolling 12 month period of Family and Medical Leave to employees with at least 1 year of service and who have worked 1,250 hours or more in the previous 12 months. To be eligible for Family and Medical Leave, your absence must be due to one of the following reasons:

  1. birth of a child or placement of a child with you for adoption or foster care (note that the eligible employee may be either the father or the mother)
  2. the employee’s own serious health condition
  3. the need to care for your spouse, child or parent due to his/her serious health condition
  4. because of a qualifying exigency arising out of the fact that your spouse, son/daughter or parent is on covered active duty or call to covered active duty status with the Armed Forces
  5. because you are the spouse, son/daughter, parent or next of kin of a covered service member with a serious injury or illness.

What is the process to request FMLA?

  1. Contact Human Resources at hr@archindy.org for the form.  Return a completed copy to both Human Resources and your business manager.
  2. If you have short term disability, it is the employee’s responsibility to contact the disability insurance carrier.

FAQ’s:

  1. Do I have to request FMLA if I have enough paid sick/vacation time to cover my leave of absence?  YES!  FMLA is in no way related to paid time off.  FMLA is what protects your job for 12 weeks.
  2. How do I pay for my insurance premiums while on FMLA?  If you have paid time, your insurance premiums will continue to be deducted from your paycheck.  If you do not have a paycheck, then you will need to make payment arrangements with human resources.

 

FMLA – Military Family Leave Entitlements

Eligible employees with a spouse, son, daughter, or parent on active duty or called to active duty status in the National Guard or Reserves in support of a contingency operation may use their 12-week leave entitlement to address certain qualifying exigencies. FMLA also includes a special leave entitlement that permits eligible employees to take up to 26 weeks of leave to care for a covered servicemember during a single 12-month period.

They will give you the forms you will need to complete – a Request for Family and Medical Leave form, and for medical leaves, a Certification of Health Care Provider form.
