“The Gentle Judge, the Lord Jesus”
Welcome to all who are searching for further information regarding the procedural reforms proclaimed by Pope Francis regarding the process for a declaration of nullity of marriage, commonly referred to as an “annulment.” These reforms were published September 8, 2015 in the Apostolic Letter entitled “Mitis iudex Dominus Jesus,” translated as “The Gentle Judge, the Lord Jesus.” We want to inform you about the changes that will become effective on December 8, 2015, the beginning of the Holy Year of Mercy. We have good news to communicate!
One of the most significant changes will involve the elimination of a mandatory appeal for affirmative decisions. In other words, if a petitioner receives an affirmative sentence declaring the nullity of the bond of marriage, no further appeal or ratification will be necessary. In practical terms, this will eliminate several months from the length of time of the process and other potential protracted difficulties.
Another significant change will involve the jurisdiction of the Tribunal of the Archdiocese of Indianapolis. If a petitioner lives in our Archdiocese, we will be competent to process the case even if the respondent lives in another country and/or the marriage took place in another country. This reform will allow our Tribunal, for example, to better serve those in our intercultural community to proceed forward with a marriage nullity case where many barriers previously existed.
Further, in accord with the request of the Holy Father, Archbishop Tobin has already proactively eliminated all fees associated with the marriage nullity process as of July 1, 2015.
